Welcome to the website and online services of the Henderson County Republican Party (referred to as “we,” “us,” “our,” or “Henderson County Republican Party”). These Terms of Service (“Terms”) govern your access to and use of https://www.hendersoncountyncgop.org/ and any related services, features, content, or applications we offer (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility and Accounts

You may use the Service only if you can form a binding contract with us and are not barred from doing so under applicable law. If you register an account or provide information (including by following, liking, or linking an account on a third-party website or network), you agree to provide accurate, current, and complete information. You are responsible for maintaining the secrecy of your unique password and account information and for controlling access to your email communications from us at all times. You are responsible for all activity that occurs under your account.

2. User Content

You may provide information or content you post to the Service (“User Content”). Any personal information or content that you voluntarily disclose for posting becomes available to the public, as controlled by any applicable privacy or website customization settings. If you remove information that you posted, copies may remain viewable in cached and archived pages, or if other users have copied or saved that information. Following termination or deactivation of your account, we may retain your profile information and User Content for a reasonable time for archival purposes. We may also retain and continue to use indefinitely all information (including User Content) contained in your communications to other users or posted to public or semi-public areas of the Service after termination or deactivation of your account. We reserve the right, but have no obligation, to monitor the User Content you post. We reserve the right to remove any such information or material for any reason or no reason, including without limitation if in our sole opinion such information or material violates, or may violate, any applicable law or to protect or defend our rights or property or those of any third party. We also reserve the right to remove information upon the request of any third party.

3. SMS Terms of Service

Go to https://www.hendersoncountyncgop.org to sign up to receive fundraising solicitations from the Henderson County Republican Party by opting into the program. After signing up, you will receive a text message from us on your mobile number. Message frequency may vary. Message & data rates may apply. We do not share or sell your mobile phone telephone number with any third parties unless required by Federal, State, or Local Law enforcement agencies under an order by the court.

Compatible carriers include AT&T, T-Mobile®, Verizon Wireless, Sprint, Boost, Alltel (Verizon Wireless), U.S. Cellular, Cellular One, MetroPCS, ACS/Alaska, Bluegrass Cellular, Cellular One of East Central Illinois, Centennial Wireless, Cox Communications, EKN/Appalachian Wireless, GCI, Illinois Valley Cellular, Immix/Keystone Wireless, Inland Cellular, Nex-Tech Wireless, Rural Cellular Corporation, Thumb Cellular, United Wireless, West Central (WCC), Cellcom, C Spire Wireless, CellSouth, Cricket, Cincinnati Bell and Virgin Mobile®. Carriers are not liable for delayed or undelivered messages.

4. Email Communications

By providing your email address (including by following, liking, or linking your account on a third-party website or network), you consent to our using the email address to send you Service-related notices, including any notices required by law, in lieu of communication by postal mail. You also agree that we may send you notifications of activity on the Service to the email address you give us, in accordance with any applicable privacy settings. We may use your email address to send you other messages, such as newsletters, changes to features of the Service, or other information. If you do not want to receive such email messages, you may opt out.

5. Privacy

Your use of the Service is also governed by our Privacy Policy, available at https://www.hendersoncountyncgop.org/. Please review it carefully. The Privacy Policy explains how we collect, use, and share information about you.

6. Third-Party Services and Links

The Service uses the Wix platform and Google Analytics, among other third-party services. Their use of information is governed by their own policies. We are not responsible for the practices employed by websites linked to or from the Service, nor the information or content contained therein. When you use a link to go from our Service to another website, our Terms and Privacy Policy no longer apply. Your browsing and interaction on any other website is subject to that website’s own rules and policies.

7. Prohibited Conduct

You agree not to use the Service in any way that:

Violates any applicable law or regulation;
Infringes the rights of others;
Interferes with or disrupts the Service;
Attempts to gain unauthorized access to any systems or networks; or
Posts content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.

We reserve the right to investigate and take appropriate action, including removing content or suspending or terminating accounts, for any violation of these Terms.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination will survive (including ownership provisions, warranty disclaimers, indemnity, and limitations of liability).

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected. No data transmission over the Internet is 100% secure. We cannot guarantee the security of information you transmit via the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE HENDERSON COUNTY REPUBLICAN PARTY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on the Service and update the “Last Updated” date. Changes are effective when posted. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

It is our policy to provide notifications, whether required by law or for marketing or other business-related purposes, via email notice, written or hard copy notice, or through conspicuous posting of such notice on the Service, as determined by us in our sole discretion.
